Thabile Gcabashe

Thabile is a Solicitor based in our Dubai office and has represented clients in both the construction and insurance sector.

She has acted for leading reinsurers and insurers in complex commercial disputes arising from insurance claims, focusing on professional indemnity, construction, and infrastructure. Thabile has also advised clients across various industries on data breaches and cyber law, including guidance on incident response policies and addressing coverage issues following a breach.

In the construction industry, Thabile has acted for employers, contractors, and subcontractors in both contentious and non-contentious disputes under various contracts, including FIDIC, NEC, GCC and bespoke construction contracts tailored to a specific project. Her work also includes providing contract management support to help clients successfully navigate and complete large-scale projects.

Thabile has spent a year in-house with a leading insurance company where she worked closely with senior underwriters gaining valuable insight into the underwriting process and risk assessment. This exposure has deepened her understanding of business operations, enhancing her ability to deliver tailored legal advice and solutions to her clients in the insurance and construction sector.

Notable cases:

  • Advising facultative reinsurers on a 70 million rand claim in relation to an asset policy following the collapse of a roof.
  • Advising insurers on coverage, claims and defences in relation to various lines of insurance, including financial lines, professional risks, and property and plant. Examples include D&O, E&O, professional indemnity and comprehensive general (third-party) liability policies.
  • Advising a Paris headquartered, bulk earthworks contractor on delays caused by the employer impacting the date of practical completion and contract value in terms of the contract (FIDIC) in arbitration proceedings.
  • Advising a German multinational contractor on a defective work damages claim in respect of design, manufacture and supply work completed in a commercial dispute.
